Art. 1. TEMPEX Ltd. takes measures to protect the general data of the User pursuant to Regulation (EC) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (GDPR) and the Personal Data Protection Act.

Art. 2. TEMPEX Ltd. processes the general data of the User on the grounds of Art. 6, para. 1, b. of GDPR - processing the data is necessary to execute a contract to which the entity is a party.

Art. 3. TEMPEX Ltd. has published information regarding the general data, which is been processing and the purposes for that and also all the required information pursuant to Regulation (EC) 2016/679 of the European Parliament and of the Council 27 of April 2016 on the protection of natural persons with regard to the processing of general data and on the free movement of such data and repealing Directive 95/46/ EC (GDPR) in Mandatory Information on the Rights of Data Protection, available on this address, with which the user declares with the acceptance of and these general terms and conditions that they are familiar with and agree.

Art. 4. When providing the service TEMPEX Ltd. acts only on the instructions of the User of the service and only insofar as it may have control over the general data that the user processes. The contract for the use of service and the use of its functions and capabilities are made available by TEMPEX Ltd.

Art. 5 For security reasons of the user's general data, TEMPEX Ltd. will send the data only via email, created by the User at the moment of registration.

With the acceptance of these Terms of Use, the Client gives his/her indefinite, explicit and unconditional consent, to his/her explicit express written revocation, the personal data provided by him/her to be collected, stored, processed and used by www.icontrol.bg and / or third parties authorized by the Company, including, but not limited to, courier services for the purpose of executing the distance and delivery contract for ordered goods, banks and financial institutions in the case of online credit purchase and in connection with an application credit granting and performance of the credit agreement in connection with the marketing and advertising purposes and analyzes of www.icontrol.bg, as well as any other law not prohibited by law. Each of our clients may at any time receive information about how their personal data is processed and used by www.icontrol.bg, as well as the purposes of their processing and use.

www.icontrol.bg will provide only the services presented on the site. All of the information presented on the site, including the stock and prices, is valid only at the moment of its submission and www.icontrol.bg reserves the right to change at any time without a notice. Every customer has the responsibility to check the terms of use of the site, as well as the information for prices, stocks, etc. to be informed if any changes have occurred. In any cases, the change takes effect in the future and will not affect any confirmed orders from www.icontrol.bg. In case it is necessary an additional approval on our part, it should be given, otherwise, regardless of the confirmation of the order, it will be considered invalid.

The provisions of the legislation in force in the Republic of Bulgaria shall apply to matters not regulated in these general conditions. All disputes concerning the interpretation and implementation of these general terms and conditions and the interpretation and execution of distance contracts for goods commissioned by the online store will be settled by agreement and, in the event of failure to do so, the dispute will be referred to the competent court: on claims by consumers - according to Art. 113 Code of Civil Procedure, and in other cases, if the jurisdiction is not imposed imperatively - before the competent court in Plovdiv, according to the rules of the generic jurisdiction under the Civil Procedure Code, namely the Plovdiv District Court or the Plovdiv City Court.

The commencement of the business relationship between the customer and www.icontrol.bg, owned by TEMPEX Ltd., begins after an order has been placed through the online shopping store of www.icontrol.bg. This process includes the completion of required general and business data, compliance with the general conditions for using the online store www.icontrol.bg and finishing the order.

The completion of the order begins the moment a company employee takes part in it. If the order is sent after working hours, but in the working week or non-working day, the execution will begin on the next working day or week. In the event of a change in the value of the ordered goods between the sending od the order and its commencement, the customer pays the goods at the price at which whey have ordered it.

The customers have the right to change or cancel their order within an hour, after placing it on a working day. When changing an order which is already made, the customer is not forced to purchase a product with the same value or from the same brand. In case if there is already an invoice, it could be cancelled or an issued a credit note.

You will receive your order by a courier with which TEMPEX has a contract. The send orders by a courier are at the expense of the customer. The delivery amount appears automatically and is calculated in final prices of the product. If the customer collects his order from a retail store, there will be no charge for delivery.

Orders are being processed in with 3 working days. Delay may occur in the following circumstances: official holidays; if the product is not on a stock by the importing company; incorrect data of the customer; mistakes made by the courier company.

In case the customer wants to use a different courier company, one that TEMPEX does not have a contract with, the user must pay by the pricelist of the chosen courier company.

The customer has the right to cancel an order if its product or package has been damaged during transportation.

Upon receipt of the goods, the buyer is obliged to immediately inspect them and, in the event that he finds obvious defects, the absence of any of the accompanying accessories and/or any of the documents required by Bulgarian legislation, to immediately inform the person carrying out the delivery. If he does not do this, the goods are considered approved, and the buyer loses the right to later claim that it was delivered to him with obvious defects, the absence of any of the accompanying accessories and/or any of those required by Bulgarian legislation documents. Complaints about goods purchased through the online store are carried out according to the rules of the ЗПСССУПС and ЗПП (for users only) and/or in accordance with the terms and conditions of their commercial guarantee.

Payments can be made with by cash, credit/debit cards or by bank transfer.

All prices on the online website are final with VAT.

If the customer is paying by cash, they need to make the payment to the courier when receiving the order. An advanced payment is not necessary. After the payment is made, the contract is in force by both sides.

Warranty

All products offered by www.icontrol.bg are new and come in original package with respective warranty period specified by the manufacturer and according to the law of Customer Protection. If a defect occurs within the warranty period, please contact th authorized service, which addresses you can find in the warranty card of your product. Based on Art. 50 of the Civil Code, the consumer has the right to withdraw from the contract at a distance without giving a reason, without paying compensation or a penalty and without paying any costs (with the exception of the costs provided for in Art. 54, Para. 3 and Art. 55 of the Civil Code) within 14 days from the date of acceptance of the goods by the consumer or by a third party other than the carrier and specified by the consumer, or when the consumer has ordered many goods with one order that are delivered separately - considered from the date on which the consumer or a third party, other than the carrier and specified by the consumer, accepts the last goods. The right of refusal can only be exercised if the user has presented to TEMPEX the goods in their original packaging in a preserved commercial form, all accessories, accessories, documents and the original receipt/invoice for the purchase. In the case of exercising the right to withdraw from a distance contract, the consumer must send or hand over the goods back to TEMPEX no later than 14 days from the date on which the consumer notified TEMPEX of his decision to withdraw from the contract. Until the goods are handed over to TEMPEX, the risk of their accidental loss or damage is borne entirely by the user.

You may complete and submit electronically the attached standard opt-out form or other unambiguous opt-out application on our website (add web address). If you use this option, we will immediately send you in a durable medium (eg by e-mail) a message confirming receipt of the opt-out. In order to comply with the withdrawal period, it is sufficient before the expiry of the withdrawal period: to successfully complete the withdrawal procedure or to send us a message regarding the exercise of the right of withdrawal. Action of refusal. If you exercise your right to withdraw from a distance contract, we will reimburse you by bank transfer, to a bank account specified by you in a Bulgarian bank, all payments we have received from you, including delivery costs (with the exception of additional costs related to with a delivery method chosen by you other than the cheapest standard delivery method offered by us) without undue delay and in any case no later than 14 days from the date on which you inform us of your decision to refuse . We have the right to delay refunds until we receive the goods back or until you provide us with evidence that you have sent back the goods, whichever occurs first. We expect you to send or return the goods to us without undue delay and in any event no later than 14 days after the day on which you inform us of your withdrawal from this contract. You must bear the direct costs of returning the goods.

According to Art. 57, item 5 of the PPE are not subject to return sealed goods that have been unsealed after their delivery and cannot be returned due to reasons related to hygiene or health protection;

In the event that, in connection with the cancellation of the contract, it is necessary to take back the goods provided by you, TEMPEX will not be responsible if the same is not taken back by you within a period of 30 (thirty) calendar days.

When requesting the return of goods purchased through an online payment purchase, it is necessary to return all goods purchased with the relevant payment purchase, specifying individual goods is not applicable. In this case, you should direct all your claims for a refund of the price paid directly to the relevant financial institution that credited the online purchase with which you purchased the item(s) subject to the relevant return request.

In the case of exercising the right of withdrawal from a distance contract, the consumer must send or hand over the goods back to TEMPEX no later than 14 days from the date on which the consumer notified TEMPEX of its decision to withdraw from the contract. Until the goods are handed over to TEMPEX, the risk of their accidental loss or damage is borne entirely by the user.
